- Governing Law

- Cancellation and Refund
- Cancellation by Allottee – The Allottee shall have the right to cancel/withdraw from the Project as per the terms of this Agreement. In such an event, the Promoter shall be entitled to forfeit the booking amount and/or administrative charges as specified herein, and the balance amount, if any, shall be refunded to the Allottee within a period of 45 (forty-five) days from the date of such cancellation.
- Cancellation by Promoter – In the event the Promoter cancels the allotment due to any reason not attributable to the Allottee, the Promoter shall refund the entire amount received from the Allottee along with interest at the rate prescribed under the Real Estate (Regulation and Development) Act, 2016, within 45 (forty-five) days.
- Delay in Possession – If the Promoter fails to deliver possession of the Unit within the time stipulated under this Agreement (except for Force Majeure conditions), the Allottee shall be entitled to: (a) Continue with the Project and receive interest for every month of delay, or (b) Withdraw from the Project and receive a full refund of the amount paid along with interest as prescribed under RERA.
- Non-Refundable Charges – The Allottee agrees that statutory payments such as stamp duty, registration charges, GST, and other government levies, once paid, shall be non-refundable.
- Mode of Refund – All refunds shall be made by the Promoter to the Allottee through banking channels (NEFT/RTGS or cheque/ Payment Gatway ) within the prescribed timeline, subject to submission of required documents.
- Dispute Resolution – Any disputes arising out of or in connection with this clause shall be subject to the jurisdiction of the RERA Authority and courts at Pune, Maharashtra.
